Overview
Welcome to Cashurse. These Terms of Service ("Terms") govern your access to and use of our website, online store, and related services (collectively, the "Services").
The terms "we," "us," and "our" refer to Cashurse, a trading name of Jacobi Detailhandel B.V., a company registered in the Dutch Trade Register (Kamer van Koophandel) under number 01023495, with its registered seat in Drachten and visiting address at Eijzengapaed 2, 9215VV De Veenhoop, the Netherlands.
By accessing, browsing, or using any part of the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all Terms, you must not access or use the Services.
Section 1 — Eligibility & Account Responsibilities
By using the Services, you represent and warrant that:

You are at least 18 years old, or you are using the Services with the consent of a parent or legal guardian.

You have the legal capacity to enter into these Terms.

You agree to provide accurate, current, and complete information when placing an order, and to keep such information up to date.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.
If you believe your account has been compromised, please notify us promptly at info@cashurse.com.
Section 1B — Product Nature & Material Care
Cashurse products are porcelain vases, glazed and finished by hand. As with any handmade ceramic item, minor variations in glaze tone, texture, or finish may occur between the item pictured and the item you receive; these variations are characteristic of the material and are not considered defects.
Our vases are glazed to be watertight and suitable for holding water and fresh flowers directly. Please avoid exposing vases to sudden temperature changes (for example, filling with very hot water immediately after cold storage), as this can cause cracking.
Porcelain is durable but can chip or crack under impact. We recommend handling with care, especially when filling, emptying, or cleaning, and hand-washing unless a specific product listing states it is dishwasher-safe.
Section 2 — Products & Service Information
We strive to display product descriptions, images, and specifications as accurately as possible. However, because our products are made from natural stone, colours, veining, and surface texture may vary between the item pictured and the item you receive, and minor variations may occur due to the natural material or manufacturing batch.
We reserve the right to modify product descriptions or pricing, limit quantities, and discontinue products without prior notice.
Section 3 — Orders & Contract Formation
3.1 Order Process
Placing an order constitutes an offer to purchase. Your order is accepted, and a binding contract is formed, once we send you an order confirmation email. Payment confirmation alone does not constitute acceptance if we later identify a pricing, stock, or fraud issue as described below.
3.2 Order Refusal & Cancellation
We reserve the right to refuse, cancel, or limit orders, including where:

A pricing or product description error has occurred.

Payment cannot be verified, is invalid, or is otherwise not accepted by our payment provider.

We reasonably suspect an order is connected to fraud, unauthorised use of a payment method, or other unlawful activity.

The ordered product is unavailable or has been discontinued.

The order appears to be for commercial resale without our authorisation.
Purchases are intended for personal end use. Orders for commercial resale require our prior written consent.
Section 4 — Pricing & Payments
All prices are displayed in euros (EUR) and include Dutch VAT (BTW) where required by law, unless stated otherwise. Prices are subject to change without notice.
4.1 Payment Methods
Payments are processed through Wix Payments and such other methods as may be made available at checkout from time to time.
4.2 Third-Party Processor Terms
When you pay via Wix Payments, you are also agreeing to Wix's applicable payment terms and privacy notices. You must comply with those third-party terms; if you do not agree to them, please choose a different payment method where available.
4.3 Authorisation & Verification
By submitting payment information, you represent that you are the lawful owner or authorised user of the payment method used, and that the information provided is accurate and complete. Our payment provider may perform identity, fraud, or eligibility checks and may decline transactions under its own risk procedures.
4.4 Shipping Costs & Import Duties
We cover all standard shipping costs and any applicable import duties or customs fees for orders within the Netherlands at no additional cost to you.
Section 5 — Shipping, Delivery & Risk of Loss
5.1 Delivery Estimates
We currently ship only within the Netherlands. Estimated delivery time is 2–5 business days from dispatch.
Shipping estimates do not include order processing time. Delivery estimates are provided in good faith but are not guaranteed.
5.2 Risk of Loss
Risk of loss and damage to products passes to you once the order is delivered to the address you provided, consistent with Dutch consumer law (which generally places risk with the seller until the consumer, or a third party designated by the consumer, physically receives the goods).
5.3 Shipping Address Accuracy
You are responsible for ensuring that the shipping address provided at checkout is complete and accurate. If a package is delayed, undeliverable, or returned to us due to an incorrect or incomplete address you provided, we will contact you to arrange redelivery; a reshipment fee may apply where the carrier charges us for the failed attempt.
If you notice an error in your shipping address after placing your order, please contact us immediately at info@cashurse.com. We will do our best to correct it, but cannot guarantee changes once an order has been dispatched.
Section 5A — Service Modifications & Availability
We may modify, update, suspend, or discontinue any part of the Services at any time. We do not guarantee that the Services will be available without interruption, and we will not be liable for any modification, suspension, or discontinuation of the Services, except where mandatory Dutch or EU consumer law requires otherwise.
Section 6 — Intellectual Property
All content on the Services, including text, graphics, logos, images, and design elements, is owned or licensed by Cashurse / Jacobi Detailhandel B.V. and is protected by applicable intellectual property law. You may not reproduce, distribute, modify, or otherwise exploit any such content without our prior written consent.
Section 7 — Third-Party Tools & Services
Our Services may rely on third-party tools (for example, our payment provider and website platform), provided "as is" and "as available." We are not responsible for the availability, accuracy, or performance of third-party tools, and your use of them is subject to their own applicable terms.
Section 8 — Third-Party Links
Our Services may contain links to third-party websites. We do not control or endorse these websites and are not responsible for their content, policies, or practices.
Section 9 — Platform Disclaimer
Our online store is built using a third-party website platform. Sales are made directly between you and Jacobi Detailhandel B.V.; the platform provider is not responsible for products, transactions, or disputes arising from your purchase.
Section 10 — Privacy & Data
Your personal information is collected, used, and disclosed in accordance with our Privacy Policy. By using the Services, you acknowledge that your data will be processed in compliance with the EU General Data Protection Regulation (GDPR) and applicable Dutch data protection law.
Section 12 — Errors & Corrections
We reserve the right to correct errors, inaccuracies, or omissions, and to cancel or adjust orders where information was inaccurate, including after an order has been submitted. Such errors may relate to product descriptions, pricing, or availability.
Section 13 — Prohibited Uses
You agree not to use the Services to:

Violate any applicable law or regulation.

Infringe intellectual property or other proprietary rights.

Submit false, misleading, or fraudulent information, including in connection with any payment dispute.

Transmit malware, viruses, or other harmful code.

Attempt to gain unauthorised access to, interfere with, or disrupt the Services.

Use automated means (bots, scrapers) to access or copy the Services without our prior written consent.

Purchase products for commercial resale without our prior written consent.
We reserve the right to suspend or terminate access to the Services for actual or suspected violations of these Terms.
Section 14 — Termination
We may terminate or suspend your access to the Services at any time, including if we reasonably believe you have violated these Terms or applicable law. Obligations incurred prior to termination, including payment obligations, remain enforceable.
Section 15 — Disclaimer of Warranties
The Services and products are provided "as is" and "as available," without warranties of any kind beyond those required by mandatory Dutch and EU consumer law, including the statutory conformity requirements described in Section 20.7.
Section 16 — Limitation of Liability
To the maximum extent permitted by Dutch law, Cashurse and Jacobi Detailhandel B.V. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services or products.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under Dutch or EU consumer protection law, including liability for death or personal injury caused by negligence, for fraud, or for defective products under the Dutch Product Liability Act (implementing the EU Product Liability Directive).
Section 17 — Indemnification
You agree to indemnify and hold harmless Cashurse and Jacobi Detailhandel B.V. from claims arising out of your misuse of the Services, your breach of these Terms, or your violation of applicable law, to the extent permitted by Dutch law.
Section 18 — Severability
If any provision of these Terms is deemed unlawful or unenforceable, that provision will be severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Section 19 — Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cashurse regarding your use of the Services.
Section 20 — Statutory Cancellation Rights (Netherlands / EU Consumers)
20.1 Your Statutory Right to Cancel (14-Day Cooling-Off Period)
If you are a consumer purchasing through our Services at a distance (online), you have a statutory right to cancel your order without giving any reason within 14 calendar days of the day you (or a third party you designate) receive the goods ("the cancellation period"), in accordance with the Dutch Wet Koop op Afstand and the EU Consumer Rights Directive.
If your order consists of multiple items delivered separately, the 14-day period runs from the day after you receive the last item.
To exercise this right, you must inform us of your decision to cancel before the cancellation period expires, by email or post:

We will acknowledge receipt of your cancellation without delay.
20.2 Extended Change-of-Mind Returns (Commercial Policy)
In addition to your statutory 14-day cancellation right, we offer an extended 30-calendar-day change-of-mind return period for eligible products, beginning the day after you receive your goods.
To initiate a return under this extended policy, contact us within the 30-day window at info@cashurse.com. This extended policy is a commercial courtesy and does not affect your statutory rights under Section 20.1 or 20.7.
20.3 Effects of Cancellation & Refunds
If you cancel within the statutory 14-day period, we will reimburse you:

The full price you paid for the product(s); and
-
The standard delivery charge you paid to receive the goods, if any.
We will process your refund within 14 days of the earlier of: the date we receive the returned goods, or the date you provide evidence that you have returned them (e.g., a tracked return receipt). Refunds will be made to your original payment method.
20.4 Return Shipping Costs
Because we cover shipping costs on the original order, we will also cover the cost of return shipping for both the statutory 14-day cancellation and the extended 30-day return — you will not be charged a return shipping fee under either policy, unless the item is faulty through misuse (see 20.5).
20.5 Conditions for Return
You may handle and inspect the product as you would in a physical shop. If you use the product beyond what is necessary to establish its nature, characteristics, and functioning — resulting in diminished value — we reserve the right to make a reasonable deduction from your refund to reflect that reduction in value. Returned products should include original packaging where possible.
20.6 Exceptions to the Cancellation Right
The 14-day statutory cancellation right does not apply to:

Goods made to your specification or clearly personalised (e.g., custom engraving, if offered).
20.7 Faulty, Misdescribed, or Non-Conforming Goods
Separately from the cancellation right above, your statutory rights under Dutch conformity law (Boek 7 BW, non-conformiteit) apply to all goods we sell. Goods must be of satisfactory quality, fit for purpose, and as described.
This includes items damaged in transit or defective on arrival (for example, a chipped or cracked stone item, or a soap dispenser pump that does not function from receipt). If your goods are faulty, misdescribed, or damaged on arrival, please contact us at info@cashurse.com within a reasonable time of discovering the issue, ideally with photos of the damage, and you may be entitled to a repair, replacement, or full refund, including return shipping costs at our expense.
Nothing in these Terms limits your rights under Dutch or EU consumer protection law.
Section 21 — Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Netherlands.
Any disputes arising out of or in connection with these Terms will be submitted to the competent court in the Netherlands, without prejudice to any mandatory right you may have as a consumer to bring proceedings before the court of your own place of residence, or to use the European Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
Section 22 — Changes to Terms
We may update these Terms from time to time. The "Last Updated" date at the top indicates when these Terms were last revised. For material changes, we will make reasonable efforts to notify you (for example, by email or a notice on the Services) before the changes take effect.
Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
Section 23 — Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganisation, or sale of assets.
